The Contingency Fee Rule: You Only Pay Your Attorney if You Win Benefits

The most important thing to know about how much it costs for a disability lawyer is that they work on a contingency fee basis. This means payment is dependent on winning your case. Here are the main guidelines:

  • No Upfront Fees: You do not pay a retainer or an hourly rate to start your case.
  • No Win, No Fee: If the SSA denies your claim and you do not receive benefits, you owe us $0 in attorney fees.
  • Direct Payment: If we win, the SSA pays the attorney’s fee directly from your award, so you don’t have to worry about writing a check.

How Much Do Disability Lawyers Charge?

The SSA strictly limits the disability attorney’s fee amount. As of 2026, the cap on attorney fees is set to undergo annual review. Currently, lawyers can charge up to 25% of a claimant’s back pay, capped at a maximum of $9,200. You will pay whichever amount is less.

Because the Social Security application process can take months or even years, the SSA often owes back pay, or past-due benefits, by the time you are approved. Back pay is the sum of money that covers the period from when you first applied for benefits until the date your claim was finally approved. For SSDI, it can also cover the period from when you first became disabled (and eligible for benefits) to your application date.

Since your attorney’s fee is taken only from your back pay amount, your ongoing monthly checks remain 100% yours.

Are There Any Additional Charges?

While the legal fee itself is capped and contingency-based, there are occasionally small out-of-pocket expenses related to building evidence for your claim. These are separate from the main fee and may include:

  • Medical Records: Some doctors or hospitals charge a fee to print or electronically transfer your medical history.
