Appeals in Tennessee: Disability Denial & Claims Attorneys

If you have had a disability application denied, you are not alone. Only one-third of all initial claims are approved, but don’t lose hope. You can still be approved for disability benefits through the appeals process.

The disability attorneys at Drozdowski & Rabin PLLC understand how frustrating it can be to spend all that time putting together a case and have it wrongfully denied. We can file an appeal on your behalf with revised or updated information and inclusive supporting evidence.

Appeals for Denied Applications

When a disability claim is denied benefits, the next step is to file an appeal. This process can be lengthy, depending on how many times we have to file. In total, there are four steps involved in appealing a denial of benefits.

While a disability lawyer is not required for an appeal, having one greatly increases the chances of approval. Additionally, we do all the work for you, from obtaining medical records and evidence to filing the proper forms in a timely manner. We know what the Social Security Administration (SSA) looks for when reviewing claims, and we make a point to include everything needed to support your claim.

4 Steps in the Appeals Process

There are four steps involved in appealing a denied claim once an application for benefits has been denied. Our Knoxville disability lawyers file all paperwork and keep you updated throughout your case.

1. Request Reconsideration

This step is pretty straightforward, involving a revised or updated application with additional medical support. We look at what information was originally included, and determine what else will help prove to the SSA that you are eligible for disability benefits.

2. Administrative Law Judge Hearing

This step allows you to speak directly with an Administrative Law Judge (ALJ) to explain details that may be difficult to do through a form or documentation. Our disability attorney will be by your side the whole time, so you don’t have to go through it alone.

3. Appeals Court Review

When a case is reviewed by the Appeals Court, they may decide the ALJ’s decision was correct. They can also send it back for review by a different ALJ for a second opinion, or they may approve it at this time.

4. Federal Court

Filing a civil suit in a federal court is the last step in the appeals process. It’s important to have a disability attorney with courtroom experience. The disability lawyers at Drozdowski & Rabin PLLC have extensive experience with disability cases on a federal level, and we will aggressively fight on your behalf.
