Appeals for Denied Applications

When a disability claim is denied benefits, the next step is to file an appeal. This process can be lengthy, depending on how many times we have to file. In total, there are four steps involved in appealing a denial of benefits.

4 Steps in the Appeals Process

1. Request Reconsideration

This step is pretty straightforward, involving a revised or updated application with additional medical support. We look at what information was originally included, and determine what else will help prove to the SSA that you are eligible for disability benefits.

2. Administrative Law Judge Hearing

This step allows you to speak directly with an Administrative Law Judge (ALJ) to explain details that may be difficult to do through a form or documentation. Our disability attorney will be by your side the whole time, so you don’t have to go through it alone.

3. Appeals Court Review

When a case is reviewed by the Appeals Court, they may decide the ALJ’s decision was correct. They can also send it back for review by a different ALJ for a second opinion, or they may approve it at this time.

4. Federal Court
